We also govern the access of the use of the connected mobile application (Collectively, the “App”), any hardware we ship or sell to you (any such hardware is referred to herein as a “Device”, “Medical Device”), collectively referred to as the “Service” By using or accessing our “Service”, you are agreeing to adhere to all the terms and conditions outlined in these Terms. The terms “Services” and “Service” as used herein encompass the Device(s), App, Website, and associated services provided by Pillbox Health LLC. This service includes but is not limited to, Software (as defined below), data, subscription services, the utilization of de-identified and aggregated data for improving any of the foregoing, and other services. By using the services, creating an account, downloading software, the app, or a software update, as applicable, you indicate your acceptance of all the terms and conditions of this agreement.

YOU UNDERSTAND AND AGREE THAT OUR PROVISION OF THE SERVICE DEPENDS ON VARIOUS THIRD-PARTY PROVIDERS, INCLUDING THOSE FOR CALENDARING AND PUSH NOTIFICATIONS ETC. WE, AT THIS MOMENT, DISCLAIM ANY LIABILITY REGARDING THE SERVICES RENDERED BY SUCH PROVIDERS. IT WOULD HELP IF YOU DID NOT DEPEND ON THE SERVICE FOR LIFE-THREATENING CONDITIONS OR ANY OTHER SCENARIO WHERE THE TIMELY ADMINISTRATION OF MEDICATIONS OR OTHER TREATMENT IS CRITICAL.

THE SERVICES ARE NOT DESIGNED TO IDENTIFY WHEN A MEDICAL EMERGENCY HAS ARISEN AND, EXCEPT SAFETY SERVICES, ARE NOT ABLE TO CONTACT EMERGENCY SERVICES (9-1-1) ON YOUR BEHALF.
–THIS MARKS THE VERY FIRST VERSION OF THE SMART PILLBOX SERVICE. THIS MEANS THERE WILL BE BUGS, DEFECTS AND DISRUPTIONS IN THE SERVICES. Smart PillBox IS NOT RESPONSIBLE FOR ANY MALFUNCTIONS, INTERRUPTIONS TO SERVICE, FAILURES OF THE SERVICE, BUGS, DEFECTS, OR UNAVAILABILITY DURING THIS PHASE.
WHEN Smart PillBox RELEASES FEATURES THAT ALLOWS PROVIDER/ CAREGIVERS TO RECEIVE REAL-TIME DATA FROM THE DEVICE, DATA CAN ONLY BE VISIBLE IF THE Smart PillBox DEVICE AND APP ARE CONNECTED VIA WIFI. USERS ARE RESPONSIBLE FOR ENSURING THAT THE WIFI NETWORK MEETS THE NECESSARY SPECIFICATIONS AND REQUIREMENTS FOR THE DEVICE TO ESTABLISH A CONNECTION. ADEQUATE SIGNAL STRENGTH AND NETWORK COVERAGE ARE
VITAL FOR OPTIMAL PERFORMANCE. KEEP YOUR PHONE NEAR THE DEVICE AND ENSURE WI-FI IS ENABLED ON YOUR PHONE.
The Smart PillBox App enables you to utilize the Service through our mobile or web-based applications, which we may provide occasionally (referred to as the “App”). It is designed to work with our Smart PillBox and the app can be used without the device if the user wishes for medication adherence & management. The Services include a convenient feature for setting reminders for prescription medications (“Medications”) nutritional supplements (“Supplements”) and any other medicine that easily fits in the compartments (apart from liquid or medicine with special temperature conditions). To download and use the App and the Smart PillBox, you must be at least 18 years old.
As long as you adhere to these Terms, you have the right to download and install the App onto your mobile device and to access and utilize the Service for your personal use. However, you are not allowed to:
Using our App means you acknowledge and accept that the app’s availability relies on a third-party store Apple App Store or Google’s Android app market from Google (referred to as “App Store”). Please understand that each app store has its terms and conditions that you must agree to before downloading mobile applications, including specific terms related to the Apple App Store outlined below. Your use of our application depends on your compliance with these App Store terms and conditions. If the terms and conditions of any App Store are less restrictive or conflict with those stated in these Terms, the more restrictive or conflicting terms and conditions in these Terms will apply.
While we aim to offer reminders and accurate information through the Service, we do not endorse, represent, or warrant that the reminders will function as intended, nor do we guarantee the accuracy or reliability of the provided Content, information, services, or recommendations.
The reminders are intended to help the user take the medicine/supplement at the prescribed time as directed by your healthcare providers.YOU ARE RESPONSIBLE FOR ADHERING TO THE SPECIFIC INSTRUCTIONS OF YOUR HEALTHCARE PROVIDER.
We are not accountable for the accuracy, reliability, effectiveness, or proper use of the information you receive through the Service. If you rely on any content provided through the Service, you do so entirely at your own risk.
Read the instructions that come with your Smart PillBox and mobile application carefully. Pay special attention to the instructions about using the Service, proximity and syncing the Smart PillBox. The Smart PillBox is configured for one Account per device. Smart PillBox comes with a rechargeable battery, so make sure to charge your Smart PillBox periodically.
-The Smart PillBox does not lock. You are responsible for storing the Smart PillBox securely, away from pets, children, and unauthorized individuals.
Additionally, the Smart PillBox is not waterproof. Exercise caution to prevent it from falling into sinks, bathtubs, pools, or other locations where it may become submerged or wet.
-The Smart PillBox may be sensitive to strong magnets or powerful electric fields. Therefore, avoid placing it near strong magnets or within strong electric fields.
-Notably, the Smart PillBox is not time-zone sensitive. If you change time zones, it is necessary to re-enter information and sync it with the Smart PillBox. When traversing security-screened areas, such as airports, it is advisable to carry labels or evidence of prescriptions to show screening officials.
If the Smart PillBox completely runs out of battery, the Smart PillBox’s clock will not be set to the correct time whenever the Smart PillBox is recharged. Consequently, you must charge the Smart PillBox battery and connect it to the mobile App via WIFI for the device to remember the correct times & track the real-time data.
The Smart PillBox contains a lithium-ion battery. Rechargeable Lithium Ion batteries are potentially hazardous and can present a serious Fire Hazard if damaged, defective, or improperly used. To prevent problems with the battery, keep the battery in an environment with a temperature between 50°F and 80°F; do not attempt to charge an unhealthy battery; charge the battery in a fire-safe environment, and do not damage the battery.
Be sure to keep Smart PillBox indoors in an air-conditioned environment so that the medications inside the device do not overheat or melt, the electronics do not overheat, and the plastic does not overheat or melt.
Make sure to clean and sanitize the Smart PillBox properly to avoid contamination. Follow these four easy care tips to reduce the risk of contamination: (1) Keep it clean; (2) keep it dry; (3) keep it away from direct sunlight or heat sources; and (4) throw away the Smart PillBox if it has touched harmful substances. The Smart PillBox Service is not designed to diagnose, treat, cure, or prevent any disease. Suppose we provide Content through the service, and you have a medical condition. In that case, you should consult your doctor before using the Service. In case of a medical emergency, cease using the Service and seek advice from a medical professional.
To utilize the Smart PillBox App, you need to register (refer to our Privacy Policy for details) and create an account (“Account”). Doing so affirms that you are legally eligible to enter into a binding contract. When setting up your Account, ensure that the provided information is accurate, truthful, and pertains only to yourself unless you have explicit permission to create an account on behalf of someone else.
We reserve the right to suspend or terminate your Account if any information furnished during registration or afterwards is found to be inaccurate, false, or in violation of our Terms or if you have created more than one Account.
Maintaining the confidentiality of your password and Account is your responsibility. Notify us immediately if your password is lost, stolen, or disclosed to an unauthorized third party or if you suspect any compromise. You are accountable for activities occurring under your Account.
The Smart PillBox Website, device, app and any information related to it such as logos, graphics, and box design are the property of PillBox Health LLC or its licensors and are protected from unauthorized copying and dissemination by copyright law, trademark law, patent law, industrial design law, and other intellectual property laws. Nothing of these Terms gives you a right to use PillBox Health LLC names, trademarks, logos, domain names, or other distinctive brand features without prior written consent from PillBox Health LLC. Any future release, update, or other addition to the functionality of our Website/APP/Device shall be subject to the Agreement. Use of any such property, except as expressly authorized, shall constitute an infringement or violation of the rights of the property owner and may be a violation of federal or other laws and could subject the infringer to legal action.
Our Service may contain other content, products or services which are offered or provided by third parties (“Third-Party Content”), links to Third-Party Content (including but not limited to links to other websites) or advertisements which are related to Third-Party Content. We have no responsibility for the creation of any such Third-Party Content, including (but not limited to) any related products, practices, terms or policies, and we will not be liable for any damage or loss caused by any Third-Party Content.
While using our services, you may choose to authorize us and its third-party contractors or affiliates to retrieve and disclose your health records and protected health information. These records may not be a complete 100% comprehensive record, and these records may not be useful for diagnostic purposes. These health records will be shared with Authorized Providers to ensure great healthcare services. We do not alter or modify medical records received from third parties. If at any time you wish to revoke this authorization, you may do so by deleting your profile FROM THE APP.
Suppose you violate any of the terms outlined in these Terms, which include, but are not limited to, failure to make the necessary payments for the right to use the Service as specified by our periodic charges. In that case, we reserve the right to suspend or disable your access to, or use of, the App and Service. Upon termination, we may remove your Content. We intend to delete most information within thirty (30) days of termination. However, certain Content or information may be retained on our servers or elsewhere even after your Account has been deleted. We are not liable for any data loss resulting from the deletion of your Account or Content. If you wish to obtain a copy of your data, you can contact us at support@pillbox.health.com within ten (10) days of termination to inquire about retrieving a copy of the data you inputted into the Service.
OUR “Service” IS PROVIDED “AS IS”. WHILE “WE” TO PROVIDE ACCURATE, CURRENT AND TIMELY INFORMATION, PillBox Health LLC MAKES NO REPRESENTATION, WARRANTIES OR COVENANTS OF ANY KIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, REGARDING OUR SERVICES INCLUDING, WITHOUT LIMITATION, NO REPRESENTATION, WARRANTY OR COVENANT THAT: (I) OUR CONTENT RELATED TO SERVICE WILL BE ACCURATE, COMPLETE, CURRENT, RELIABLE, TIMELY, OF MERCHANTABLE QUALITY OR SUITABLE FOR A PARTICULAR PURPOSE; (II) THE OPERATION OF OUR SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; (III) OUR SERVICE SHALL PROCESS DATE AND TIME-RELATED DATA WITHOUT CAUSING ANY PROCESSING INTERRUPTIONS, ABNORMAL TERMINATION OR WITHOUT PROCESSING OR MANIPULATING ANY TIME-RELATED DATA; (IV) OUR SERVICE WILL BE FREE FROM MATERIAL DEFECTS OR THAT DEFECTS OR ERRORS, WHETHER HUMAN OR COMPUTER ERRORS, IN OUR SERVICES WILL BE CORRECTED; (VI) OUR WEBSITE WILL BE FREE FROM VIRUSES OR HARMFUL COMPONENTS THAT MAY DAMAGE OR INFECT YOUR DEVICE OR OTHER PROPERTY; OR THAT (VII) COMMUNICATIONS TO OR FROM OUR WEBSITE WILL BE SECURE AND/OR NOT INTERRUPTED.
YOU AGREE THAT YOU ARE RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR PASSWORD AND ANY OTHER SECURITY INFORMATION RELATED TO YOUR USE OF THE PLATFORM. YOU AGREE TO NOTIFY US IMMEDIATELY OF ANY UNAUTHORIZED USE OF YOUR USERNAME OR PASSWORD.
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL PILLBOX HEALTH LLC (OR ITS LICENSORS, SUPPLIERS, REFERRAL PARTNERS, OR OTHER INTERMEDIARIES AUTHORIZED TO DISTRIBUTE THE SERVICES TO YOU) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, OVER THE GREATER OF (A) $99 OR (B) SUBSCRIPTION PRICE THAT YOU HAVE PAIDE FOR THE SERVICE. (B) THE AMOUNTS PAID BY YOU TO IN CONNECTION WITH THE SERVICES IN.
PillBox Health LLC reserves the right at any time, and from time to time, to modify or discontinue, temporarily or permanently, our ‘Service’ or any part thereof, with or without notice to you. ‘We’ shall not be liable to you or any third party for any modifications, suspension or discontinuance of our ‘Service’ or any part thereof. If PillBox Health LLC becomes involved in a merger, acquisition, or sale of some or all of its assets, PillBox Health LLC reserves the right to re-brand or relocate its services.
PillBox Health LLC reserves the right, in its sole and absolute discretion, to determine your eligibility for any promotional offer under the applicable Promotional Terms. ‘We’ reserves the right to change, amend and alter then-current promotional offers or Promotional Terms as well as institute new promotional offers in its sole and absolute discretion. ‘We’ do not guarantee that any promotional offers are or will be available to you at all, or in connection with any services desired by you.
The prices and availability of products and services made available on the Service may change at any time without notice to you. Prices remain valid while they are listed and offered on the Service. Prices will be as posted on the Service as of the date and time of your order, as applicable. Availability of products and services may be limited, and products may not be available for immediate delivery. Some products and services may not be available in certain areas.
Certain jurisdictions may not permit the exclusion of specific warranties or the limitation or exclusion of liability for consequential or incidental damages. Therefore, the limitations stated above may not apply to you.
These Terms are governed by the laws of the State of Florida without regard to any conflict of laws, rules, or principles. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of those rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions will continue to be in effect. These Terms constitute the entire agreement between us concerning our Service, supplanting any prior agreements regarding the Service. If we make any material changes to these Terms, we will notify you through the Service, email, or other notifications and specify when such changes will take effect. Your continued access or use of our Service after the effective date of the revisions indicates your acceptance of the amended Terms.
